Data Controller
Domus Vallarta Inmobiliaria, S.A. de C.V. (commercial name: Domus-Fine Real Estate, hereinafter DVI) with address at Mar Egeo 1428-2, Country Club neighborhood, Guadalajara, Jalisco, Mexico, C.P. 44610, is responsible for obtaining, disclosing, storing, using, managing, and protecting the personal data we collect from our clients (hereinafter the Data Subjects).
Personal Data Collected
The personal data that DVI collects from Data Subjects includes, but is not limited to: Name, home address, email, age, date of birth, gender, marital status, nationality, phone number, occupation, RFC, current employment data, copy of official identification with photograph, copy of income documentation, banking references, number of economic dependents, among others. Your personal data is collected via email or through the delivery of documents that certify the aforementioned data or through data transfers.
Sensitive Data Policy
DVI does not request any information that under the law is understood as sensitive data, such as: religion, sexual preferences, political opinions, among others. The company supports and encourages diversity and therefore prohibits any discriminatory act or the request of any information that could imply a discriminatory act. If you provide sensitive data, the company will treat and safeguard it in accordance with the law.
Purpose of Data Processing
The data we collect is used for the following purposes: (I) Preparation of a service provision contract between DVI and clients to establish the terms and conditions for property promotion; (II) Preparation of lease, promise of sale, purchase contracts, transfers, or investment projects on properties promoted by DVI; (III) Management to confirm the legal status of the promoted property; (IV) Coordinating appointments with prospects at the property location; (V) Exchanging information and proposals between prospect and client related to the promoted property; (VI) Investigating the creditworthiness and legal integrity of the client; (VII) Closing any type of real estate transactions; (VIII) Informing you of promotions, offers, and launches; (IX) Marketing and prospecting activities; (X) Statistical and market analysis; (XI) Inviting you to events; (XII) Keeping our records updated.
Data Confidentiality and Security
Your personal data will be treated with the utmost confidentiality, implementing strict administrative, physical, and technical security measures in our policies and internal security procedures to avoid unlawful disclosure and limit use to what is established in this privacy notice.
Your Rights (ARCO)
At any time, you or your duly authorized legal representative may exercise the rights of access, rectification (when data is incorrect or inaccurate), cancellation, and opposition. To exercise these rights, you must submit your request to our address at Mar Egeo 1428-2, Country Club, Guadalajara, Jalisco, Mexico, C.P. 44610 or email: sistemas@domusvallarta.com with attention to the data protection department.
Request Requirements
Your request must include: (I) Your name; (II) Home address and email for response; (III) A clear and precise description of the data involved; (IV) The objective of your request; (V) Any element that facilitates data location; and (VI) A copy of your official identification and, where applicable, documentation accrediting legal representation.
Response Timeline
The response to your request will be provided within 20 business days from the date of receipt. The response will be communicated via email or letter to the address provided. Once received, you will have 15 business days to make it effective if applicable.
Consent Revocation
At any time, you may revoke the consent you have given us for the processing of your personal data by submitting a request following the ARCO procedures. Once your request is processed, your data will no longer be processed by DVI.
Data Transfers
Your personal data may be transferred to third parties, whether national or foreign, when necessary to fulfill the obligations resulting from your relationship with DVI. Any third party receiving your personal data through DVI transfers will have the same obligations and responsibilities as us as data controllers, and this privacy notice will be communicated to such third party.
Changes to This Notice
Any changes to this privacy notice will be informed to you through email and through visible announcements in DVI's operational areas. You are informed that this privacy notice may be modified at any time to address legislative updates or changes to DVI's internal policies. If the purposes for which your personal data is processed change, we will request your consent again if necessary.
